What Events Led to the Violent Disturbance in Hamilton?

The court heard that the incident unfolded on the evening of May 10 outside a property in Balfron Crescent, Hamilton.

As reported by court reporters for the Glasgow Times, prosecutor Daisy Bentley detailed that Falconer arrived at his parents’ residence after 9:00 pm while heavily intoxicated.

Upon his arrival, he began acting loudly, prompting his father, Kenneth Falconer senior, to ask him to quieten down.

According to statements presented in court by prosecutor Daisy Bentley, Falconer reacted aggressively to his father’s request.

He began throwing household objects around the property, hurled cans of beer directly at his father, and proceeded to punch the 63-year-old repeatedly on the head and body.

Kenneth Falconer senior attempted to restrain his son, but the disturbance escalated and continued for approximately two hours before the father was able to contact emergency services via 999.

How Was Police Officer Weronika Dygulska Injured During the Arrest?

Following the emergency call, PC Weronika Dygulska and a police colleague arrived at the scene and located Falconer in the garden area of the Balfron Crescent property. As outlined in the prosecution account reported by the Glasgow Times, the officers attempted to apply handcuffs to secure the accused. However, Falconer violently resisted arrest and grabbed PC Dygulska.

As reported by prosecutor Daisy Bentley during the court proceedings, Falconer began pulling forcefully at PC Dygulska, bending her wrist backwards and applying severe physical pressure.

Despite repeated instructions from the officers ordering him to cease his actions, Falconer shoved PC Dygulska to the ground while continuously twisting her wrist and applying force. Court records note that the officer screamed out in pain, stating at the scene that she believed her arm had been broken.

Although PC Dygulska’s colleague immediately called for emergency back-up assistance, the two officers managed to restrain Falconer before additional police units arrived.

PC Dygulska was subsequently transported to hospital, where medical examinations confirmed a fracture to her arm.

What Statements Were Delivered by the Prosecution and Defence in Court?

During the court hearing, the full extent of Falconer’s domestic disturbance and bail breaches was outlined to the bench. In addition to the physical attacks on his father and the police constable, Falconer acknowledged that his presence at the Balfron Crescent address was a direct violation of active bail conditions prohibiting him from visiting or contacting his parents.

Speaking in mitigation, defence solicitor Ian Scott provided context regarding his client’s recent life events and lack of historical violent offending.

As reported by court journalists for the Glasgow Times, defence lawyer Ian Scott stated that Falconer, a father of one with previous convictions, had experienced a severe personal decline following the collapse of a domestic relationship. Defence solicitor Ian Scott remarked to the court that his client

“has gone from being a law-abiding family man with a job to someone in jail for breaking a police officer’s arm.”

What Final Judgment Was Handed Down by Sheriff John Hamilton KC?

Upon receiving the guilty pleas to the charges of assault to severe injury, domestic assault, and breach of bail, the court proceeded to consider sentencing options.

Presiding Magistrate Sheriff John Hamilton KC formally noted the gravity of the offences, particularly the severe injury inflicted upon an emergency service worker in the execution of her duties.

Sheriff John Hamilton KC ordered that Falconer be remanded in custody while background reports, including criminal justice social work evaluations, were prepared. Following the deferral period for report preparation, Falconer was sentenced to a total term of 16 months’ imprisonment.

What Is the Background to This Particular Development?

Emergency service safety and police officer assaults have been a topic of increasing parliamentary and judicial scrutiny across Scotland in recent years.

Under Scottish law, the Emergency Workers (Scotland) Act 2005 specifically criminalises assaults, threats, or obstruction directed at police officers, paramedics, firefighters, and medical staff acting in an official capacity.

Furthermore, offences involving severe injury, such as fractures or permanent disfigurement, elevate standard assault charges to solemn proceedings within the Sheriff Court or High Court of Justiciary.

Statistics published by Police Scotland and the Crown Office and Procurator Fiscal Service (COPFS) indicate a steady focus on prosecuting individuals who cause physical harm to front-line emergency personnel. Courts routinely emphasize that custodial sentences remain the primary deterrent for violent acts committed against officers responding to domestic incidents.

How Will This Development Affect Police Officers and the Wider Community?

This judicial outcome directly reinforces the legal protection afforded to emergency service personnel operating in local communities across Lanarkshire and the broader Scottish judicial system.

For front-line police officers, the imposition of an immediate 16-month custodial sentence highlights the legal consequences faced by individuals who physically resist or injure officers during response calls.

For the local community in Hamilton, the resolution of this case underlines the court’s stance on domestic disturbances and bail enforcement.

By imposing imprisonment for breaches of court orders alongside physical assault, the judiciary aims to reassure members of the public that court-mandated restrictions aimed at protecting vulnerable family members will be strictly enforced.
